
Can I register a birth or marriage certificate in my Italian Comune without going through the Italian Consulate?
Well, the answer is yes.
Example 1). You are an Italian citizen living in the UK, regularly registered with the AIRE of your Italian Comune (Municipality), for example Rome, and need to register your son’s or daughter’s birth certificate in the registers of the Comune of Rome.
Example 2). You are an Italian citizen who married a US citizen in the US, you are regularly registered with the AIRE of your Italian Comune, for example Rome, and want to register your marriage in the registers of the Comune of Rome so your wife or husband can apply for Italian citizenship.
The story is usually the same in both cases. You go online, check out your local Italian Consulate’s website, find some information, and discover that you need a valid, original act of birth or marriage with Apostille or legalization (this is true, but please note that you also need a valid official translation).
So you contact the competent Vital Records Office, you request your act of birth or marriage, then request the Apostille, and you think you are good to go and only need to contact the Italian Consulate for an appointment during which you will submit your original document.
So, you try contacting the Consulate but no one answers, or if they answer they tell you that you cannot get an appointment right away. Then, you wait months, and nothing happens, and you cannot get your appointment, or, if you do, it will be in in about 5, 8, or 10 months’ time, depending on the Consulate.
You just can’t believe that it takes all this time to register a birth or marriage certificate in Italy, and feel frustrated and disappointed at the same time. You then ask yourself if there is anything you can do, because you do not want to wait all this time, especially considering that it probably took you weeks (in some countries months) to obtain the original act of birth or marriage with the Apostille.
Well, what you probably don’t know at that particular moment, is that you should not feel frustrated and disappointed because you do not need to go through the Italian Consulate and wait for ages to transcribe your children’s births or your marriage in Italy. There is a much easier and faster way to do it.
In fact, if you have your original act of birth or marriage with its Apostille (or legalization), and you already know in which Italian Comune (Rome, Milan, Venezia etc.) you should already be registered with the AIRE, all you have to do is send an email to assistance@vademecumitalia.com and I will tell you how an Italian lawyer can assist you with the transcription of your act of birth or marriage with your Italian Comune, without going through your local Italian Consulate.
As a matter of fact, you should know that with the complete orignal document (act of birth or marriage), which must bear the Apostille and translation, an Italian attorney can file the request for transcription with your Italian Comune on your behalf. The Comune will then confirm the transcription of your act of birth or marriage.
It will take you a lot less time than doing it with your local Italian Consulate.

Moroever, as I wrote in our previous guide Are you sure your marriage has actually been transcribed?, please consider that even if you request the transcription of your act with the Italian Consulate, you should know that, unfortunately, the fact that the Consulate has sent the papers (via post or via pec) to your Italian Comune, does not necessarily mean that the birth or marriage have actually been transcribed, or will actually be transcribed anytime soon, even if the papers were sent many years ago,
So, filing your request with an Italian attorney gives you the guaratee that you will be assisted from the beginning of the process to the end, when you will receive a formal communication that your act of birth or marriage has actually been transcribed.
After the transcription is performed by the Comune, I will then be able to request your “estratto per riassunto dell’atto di nascita” or “estratto per riassunto dell’atto di matrimonio” from your Italian Comune.
