How to register your second or third marriage in Italy

First things first! If you want to register your second or third marriage in Italy, remember that you first need to register your previous marriage and related divorce certificates!

Let’s explain the case with an example regarding a client we recently assisted.

An Italian /UK citizen living in the UK contacted us asking for information regarding the registration of his marriage and his son’s birth certificates in his Italian comune di Benevento (AIRE).

Now, we explained the process and sent him our quote. He agreed and we started working on the case. However, while we were gathering all the information, we discovered that he had previously been married but then he formally divorced his spouse (both events occurred in the UK). Therefore we thought that the marriage certificate he sent us was actually relative to his second marriage. So, we informed him that in order to register his second marriage, the one for which he contacted us, we would have first needed to register his first marriage and divorce. He then confirmed that he had been previously married and got divorced in the UK, but he also added that he forgot to mention to us that he actually got married three times, so the marriage certificate he sent us was now actually relative to his third marriage. Therefore, in his case there were a total of three marriages and two divorces.

Unfortunately, he never registered any of his marriages and divorces with his Italian comune. This is something that should not happen because every Italian citizen must constantly update his marital and parental status with his/her Italian comune and consulate.

Therefore, he had to collect his two previous marriage and divorce certificates, which he then sent to us. We were then able to register his three marriages and divorces, in addition to his son’s birth in the Comune di Benevento. At that point his marital and parental status had been updated and we were also able to obtain his latest marriage certificate (estratto di matrimonio) and his son’s birth certificate (estratto di nascita) in a very short period of time.

As said in many other posts, please remember that in order to obtain your marriage certificate or your children’s birth certificates, you first need to register the marriage or birth certificate with your Italian comune (don’t get confused with the Italian consulate).     

Now, the case we described above is quite a common case, as we receive many similar requests where citizens are not aware or simply do not consider that they need to register all their marriage and divorce certificates and not just their latest one.

So, please consider that if you got married more than once, you first need to register your previous marriage and divorce certificates in order to register your second or third marriage certificate.
